BreakFree Events

Refund and Returns Policy (Germany – Legal Compliance)

Break Free Events – Berlin, Germany
Last updated: {{DATE}}

This Refund Policy is written in accordance with German law, including:

  • BGB (Bürgerliches Gesetzbuch) – German Civil Code

  • EU Consumer Rights Directive (2011/83/EU)

  • Fernabsatzrecht (distance selling regulations)

Important: Under German law, event tickets are generally excluded from the 14‑day right of withdrawal (§ 312g Abs. 2 Nr. 9 BGB) because they relate to a specific date or period of performance. Therefore, the usual right to “return” or “cancel” a purchase does not apply to tickets.

1. No Right of Withdrawal for Event Tickets

According to § 312g Abs. 2 Nr. 9 BGB, consumers do not have a right of withdrawal for time‑specific leisure services, including:

  • Event tickets

  • Festival passes

  • Access to cultural events with a fixed date

Therefore, all ticket purchases are binding once completed.

2. When Refunds Are Possible

Even though the legal right of withdrawal does not apply, refunds may still be issued in the following cases:

a) Event Cancellation

If an event is cancelled by us, you are entitled to a full refund of the ticket price.

b) Event Rescheduling

If an event is moved to another date or time, you may:

  • Accept the new date, or

  • Request a refund within 14 days of notification.

c) Significant Event Changes

If major elements of the event change (e.g., venue moved to another city), you may request a refund.

d) Technical Errors

Refunds are provided in cases of:

  • Double payment

  • Failed payment that was still charged

  • System malfunction

3. Non-Refundable Situations

Refunds cannot be granted for:

  • Personal scheduling conflicts

  • Illness or travel issues

  • Failure to meet event entry conditions

  • Lost or stolen tickets

  • Tickets purchased from unauthorized resellers

  • Late arrival or missed entry due to personal reasons

These limitations are compliant with German consumer law.

4. Exchanges and Ticket Transfers

Ticket exchanges are not legally required, but we may offer them voluntarily if permitted for the specific event.

Possible options include:

  • Name change on the ticket

  • Transfer to another date (only if available)

  • Transfer to another person (if allowed)

To request an exchange, contact: {email address}.

5. Refund Procedure

If your refund request is approved:

  1. You will receive a confirmation email.

  2. Refunds are issued to the original payment method.

  3. Processing times depend on your bank (usually 5–14 business days).

6. Late or Missing Refunds

If your refund has not arrived:

  • Check your bank account

  • Contact your credit card provider

  • Ask your bank about posting delays

If you still have not received it, contact info@breakfreeevents.de.

7. Gifts

If a ticket was marked as a gift:

  • Refunds go to the original purchaser

  • Transfers may be possible depending on event rules

8. Physical Merchandise (If Offered)

If we sell physical event-related merchandise, German distance selling rules apply.

For physical goods you have a 14‑day Widerrufsrecht (right of withdrawal) in accordance with § 312g BGB, unless the item is:

  • Personalized

  • Opened (in the case of sealed media or hygiene products)

Return request must be sent to: info@breakfreeevents.de

You are responsible for return shipping costs, as permitted under German law.

9. Legal Basis

This policy is compliant with:

  • §§ 312–312k BGB (consumer contracts)
